Notice of Motion - Elected Council Submission to Sydney North Planning Panel in Relation to Development Application 162/2021 |

RESOLVED on the motion of Councillors Southwood and Kennedy that the elected Council:- 1. Notes that:- a. Council elected to proceed with the development of the St Leonards South Precinct through a council-led Planning Proposal for the precinct, rather than allowing site owners to lodge separate Planning Proposals for individual sites; b. Council’s proposed planning controls for the St Leonards South Precinct were intended to deliver on the objectives of the St Leonards South Master Plan; c. The amendments to the Lane Cove Local Environmental Plan and the Lane Cove Development Control Plan that were specific to the St Leonards South Precinct were the subject of extensive community consultation; d. The Development Control Plan for Locality 8 St Leonards South Precinct (SLS DCP), as approved by Council on 19 October 2020, includes specific controls for each Area within the precinct to further the objectives of the St Leonards South Master Plan; e. Section 7.6 (4)(g)(iv) of the Lane Cove Local Environmental Plan requires that the consent authority for a Development Application for an Area in the precinct must have regard to “the relationship of the development with other development (existing or proposed) on the same site or on neighbouring sites in terms of separation, setbacks, amenity and urban form”; f. The community had and continues to have an expectation that Council will, as stated in the report to Council of 19 October, 2020, require Development Applications lodged for the St Leonards South Precinct to be constructed to the specifications of the SLS DCP in order to qualify for LEP Incentive Height of Buildings and Floor Space Ratios bonus components; g. DA 162/2021 for Area 5 in the St Leonards South Precinct includes several design elements that do not comply with the controls applicable to it under the SLS DCP; and h. Area 5 is the first of 6 remaining contiguous sites that run along the east-west link that have not yet been the subject of a Development Application determination. 2. Supports the controls in the SLS DCP; 3. Is aware that the controls in the SLS DCP will be strengthened through a requirement that all Development Applications adhere to the controls of the DCP; 4. Is aware of the precedent effect on future Development Applications of approval of a Development Application that does not comply with the DCP; and 5. Authorises the Mayor to make a submission to the Sydney North Planning Panel, in the name of the elected Council, in the terms of this resolution, such submission to:- a. i. Request the Sydney North Planning Panel to refuse approval of DA 162/2021; ii. Authorise the Mayor to address the Panel determination hearing for DA 162/2021; and b. be circulated to Councillors prior to submission to the Sydney North Planning Panel. |
