PRESENT: Councillor S Bennison (Mayor), Councillor M Southwood, Councillor D Roenfeldt, Councillor B Kennedy, Councillor R Flood, Councillor K Bryla, Councillor D Brooks-Horn, Councillor K Mort and Councillor A Zbik.

 

ALSO PRESENT: General Manager, Director - Corporate Services and Strategy, Director - Planning and Sustainability, Director - Community and Culture, Director - Open Spaces and Infrastructure, Executive Officer, and Minute Taker.

The Mayor advised that Councillor Mort and Councillor Kennedy have requested to attend the meeting via audio visual link.

 

Procedural Motion

RESOLVED on the motion moved by Councillor Bennison and seconded by Councillor Brooks-Horn that the request by Councillor Mort and Councillor Kennedy to attend the meeting via audio visual link be granted due to exceptional circumstances.

 

For the Motion were Councillors Bennison, Southwood, Roenfeldt, Kennedy, Flood, Bryla, Brooks-Horn, Mort and Zbik (Total 9).

Against the Motion was Nil (Total 0).

DECLARATIONS OF INTEREST

 

Councillor Brooks-Horn has previously declared a non-pecuniary significant conflict of interest in relation to Item 8 -May 2024 update – Lane Cove Sport and Recreation Project.  Councillor Brooks-Horn has satisfied himself that he does not have the same significant conflict in relation to this item, and as such will be remaining in the chamber to vote on the matter as he now has a non-pecuniary less than significant conflict of interest in the matter.

 

Councillor Brooks-Horn declared a significant pecuniary conflict of interest in relation to Item 17 -Community Assistance Grants to Community Groups 2024-2025, because of his role in Sydney Community Services.  Councillor Brooks-Horn will leave the chamber for discussion of Part 3 of Council’s recommendation.

 

Councillor Kennedy declared a significant non-pecuniary conflict of interest in relation to Item 17 – Community Assistance Grants to Community Groups 2024-2025, due to being a co-founder and Executive Committee Member of the Sydney Library of Things Inc. which is involved in the strategic implementation and development of The Lane Cove Toy Library.  Councillor Kennedy will leave the chamber during debate on this matter.

 

Councillor Bennison declared a non-significant, non-pecuniary conflict of interest in relation to Item 17 – Community Assistance Grants to Community Groups 2024-2025, due to being the auditor of the Longueville Sports Club.  As he is not a member of the Sports Club executive, Councillor Bennison will remain in the chamber and vote on this item.

 

Councillor Mort declared a significant non-pecuniary conflict of interest in relation to Item 17 - Community Assistance Grants to Community Groups 2024-2025, as she has been a volunteer at Sydney Community Services for some time. As such Councillor Mort will leave the chamber and not vote on the matter.

 

Councillor Mort declared a less than significant, non-pecuniary interest in relation to Item 17 - Community Assistance Grants to Community Groups 2024-2025 as she is on the board of Lane Cove Retirement Units.  Councillor Mort is on the board in her capacity as Lane Cove Councillor, the same as Councillor Brooks-Horn.


 

Councillor Bryla declared the following conflicts of interest:

·         Item 7 - Multifunction Performance Space,  a non-pecuniary, significant conflict of interest due to having a working relationship with a member of the Lane Cove Theatre Company Committee, and I will leave the chamber and not vote on this matter.

·         Item 14 - Dogs and Sportfields, a non-pecuniary, significant conflict of interest due to having a working relationship with a member of the Dog Advisory Committee.  I will leave the chamber and not vote on this matter.

·         Item 17 – Community Assistance Grants to Community Groups 2024-2025, a non-pecuniary, significant conflict of interest as she is a member of the Theatre Company and the Swimming Club and will leave the chamber and not vote on this part of the item.

Councillor Zbik declared a non-significant, non-pecuniary conflict of interest in Item 17 -  Community Assistance Grants to Community Groups 2024-2025 as one of his children attends Birralee.  As he is not on the Board and has not attended any management meetings, he will remain in the chamber and vote on this item.

Notice of Motion - Cancellation of Partial Closure of Canberra Avenue

 

Motion

A Motion was moved by Councillor Southwood and seconded by Councillor Bryla that in the light of detail now available and to become available to Council about changes to planning controls in and adjacent to St Leonards South, namely:

·         the affordable housing/ incentive FSR provisions in Chapter 2 of the State Environmental Planning Policy (Housing) 2021 (Housing SEPP), and

·         the Transport Oriented Development (Accelerated Precincts) rezoning program for a high growth area around the Crows Nest Metro Station (TOD) and the unquantifiable impacts of these changes on the road network within the St Leonards South Master Plan area (including access roads to River Road and Pacific Highway),

that Council:-

1.    takes no further action to activate the closure of Canberra Avenue or the gazettal of road closure until the following has occurred-

(a)   when Canberra Avenue is no longer required to provide access to construction vehicles to developments that front Canberra Avenue, to erect structures to block access to and egress from Canberra Avenue from River Road and to retain these structures until a decision of Council as to the activation of the partial closure of Canberra Avenue and gazettal of road closure

(b)   whilst the structures in 1(a) are in place, conducts ongoing traffic flow monitoring in Duntroon Avenue, including at the intersection of Duntroon Avenue and River Road, and the intersection of Berry Road and Pacific Highway and maintains records of reported accidents

(c)   uploads to the Council website, on a regular basis, the information recorded in accordance with 1(b)

(d)   six months after certificates of occupancy have been issued for all developments in the area bounded by Canberra Avenue, River Road, Berry Road and Marshall Avenue, receives a report on the traffic flow in the St Leonards South precinct, particularly with reference to Duntroon Avenue, the intersection of Duntroon Avenue and River Road, and the intersection of Berry Road and Pacific Highway and recommendations on the future partial closure of the Canberra Avenue

2.    advises Top Spring of the actions to be taken in accordance with 1(a) to (d), noting that the architectural drawings included in the DA for the Top Spring development DA 99/2021 do not depict the driveway entrance in the portion of Canberra Avenue to be closed

3.    amends the consent granted to Top Spring under Section 138 of the Roads Act to clarify that no works can be undertaken on the portion of Canberra Avenue approved for partial closure until the processes outlined in 1(a) – (d) are completed.

1.    award the contract for the fit out for the early childhood education centre and community centres at 13-19 Canberra Avenue in St Leonard’s, HPG General Pty Ltd ABN 53 158 946 331 pursuant to section 55(3)(i) of the Local Government Act 1993 due to extenuating circumstances, where a satisfactory result would not be achieved through a competitive tendering process pursuant to s 55(1) of the LG Act, for the following reasons:

a)    Asset Protection: protecting Council’s asset by managing the risks associated with the building defects warranties;

b)    Timing: fulfilling a contract in time to benefit from the developer’s proposal to include the fit out in their program of works on the Site;

c)    Community Benefit:  maximising community benefits by prioritising the timely opening of the early childhood education centre and community centres to align with the building’s occupation;

d)    Expertise and Economies of Scale: the achievement quality and economies of scale; and

e)    Value for Money: having reviewed the quotation against a Quantity Surveyor estimate and as a result of the aforementioned elements achieving best value for Council.

2.    delegate authority to the General Manager to finalise and execute the agreement with Hyecorp, and any other documentation required to effect this resolution.
